As provided by law, a person shall acquire the citizenship of the Republic of Azerbaijan in the following cases: when born on the territory of the Republic of Azerbaijan, or born from citizens of the Republic of Azerbaijan; as a consequence of admission to citizenship of the Republic of Azerbaijan; in force of bilateral and multilateral international treaties of the Republic of Azerbaijan; and by other reasons stipulated by Law on Citizenship.
Foreign citizens and stateless persons, continuously and permanently living on legal grounds in the Republic of Azerbaijan for the last five years, with a legal source of income, committed to respecting the Constitution and the laws of the Republic of Azerbaijan, and also submitting a document about the knowledge of the state language can be admitted to the citizenship of the Republic of Azerbaijan upon their application in compliance with the Law on Citizenship irrespective of racial and national affiliation, sex, education, language, religious beliefs, political and other convictions, place of residence. Under Law on State Duty the state duty for applications for admitting into, restoration of, and renouncing the citizenship is set at USD 65.
The obtainment of a citizenship of a foreign country by Azerbaijani citizens is grounds for the loss of Azerbaijani citizenship. In case an Azerbaijani citizen holds another citizenship apart from that of the Republic of Azerbaijan, the former is not recognised by Azerbaijani law. Pursuant to the provisions introduced to the criminal law by Law No 1274-IVQD dated 28 April 2015, an Azerbaijani citizen obtaining a citizenship of a foreign country shall notify the Ministry of Foreign Affairs and the State Migration service within one month. Otherwise, he/she will be punished by a fine in the amount of USD 1,765 – 2,940 or public service of 360 – 480 hours.
Exceptions for the denial of recognition of an Azerbaijani citizen’s second citizenship exist where international agreements of Azerbaijan permit (there are no such agreements), or where the President of the Republic resolves, otherwise.
